dc.description.abstractTato diplomová práce se zabývá ukládáním a výkonem ochranného léčení. Cílem práce je popsat stav tohoto institutu, poukázat na některé problémy z praxe, případně pokusit se navrhnout jejich řešení. Ochranné léčení je jedním z ochranných opatření. Jeho základním úkolem je ochrana společnosti před pachatelem trestného činu. Ochranné léčení může být uloženo ve formě ústavní či ambulantní, přičemž je možné jej vykonat před, při a stejně tak po výkonu trestu odnětí svobody. Může být ovšem uloženo i bez trestu, především pokud se jedná o nepříčetného pachatele. Diplomová práce obsahuje i komparaci s právní úpravou tohoto institutu v Německu. Již v průběhu práce je poukazováno na určité problémy vznikající při výkonu ochranného léčení v praxi.cs
dc.description.abstract-translatedThis dissertation deals with sentencing and execution of protective treatment. The target is to describe a status of this institute, point to some known problems comes of practice and alternatively also to try to suggest theirs solution. Protective treatment is one of protective measures. The main task is to protect a society against perpetrator. Protective treatment can be imposed on offender in two ways of institutional form or ambulatory form. Its possible to execute it before imprisonment as well as during imprisonment and also after the prison sentence. The protective treatment may be imposed on perpetrator even without crime sentence - in case of deranged offender. This dissertation includes also a comparison with legislation of this institute in Germany. During this work it is also pointed to some concrete difficulties comes of protective treatment execution in practice.en
