dc.description.abstractDiplomová práce se věnuje tématu zkracujícího jednání dlužníka a věřitelově ochraně proti němu. Popisuje, co je považováno za zkracující jednání, uvádí dostupné prostředky pro věřitelovu ochranu s důrazem kladeným na odpůrčí žalobu jakožto stěžejního prostředku ochrany a pojednává o jejich využitelnosti v praxi. Dále se práce zabývá srovnáním obecné úpravy zkracujícího jednání a relativní neúčinnosti dle občanského zákoníku s úpravou speciální obsaženou v insolvenčním zákoně. Rovněž hodnotí současnou právní úpravu a předstírá návrhy možných změn do budoucna.cs
dc.description.abstract-translatedThe diploma thesis deals with the topic of debtor's shortening behaviour and creditor's protection against it. It describes what is considered to be a rights shortening conduct, outlines the available means of creditor protection with an emphasis on the counterclaim as the main means of protection and discusses their applicability in practice. The thesis also compares the general regulation of fraudulent conduct and relative ineffectiveness under the Civil Code with the special regulation contained in the Insolvency Act. It also evaluates the current legal regulation and presents proposals for possible changes in the future.en
