dc.description.abstractDiplomová práce na téma "Řešení sporů podle zákona o kolektivním vyjednávání" si klade za cíl, zejména přiblížit čtenáři problematiku kolektivního vyjednávání a řešení sporů z něho vzniklých. Práce popisuje kolektivní pracovní právo, proces kolektivního vyjednávání, včetně jeho subjektů, kterými jsou zejména zaměstnavatel a odborové organizace, dále kolektivní spory, které v rámci tohoto procesu vznikají. Práce se zaměřuje i na konkrétní způsoby řešení kolektivních sporů, kterým jsou věnovány samostatné kapitoly. Jedná se o řízení před zprostředkovatelem, které je obligatorní fází řešení kolektivních sporů, řízení před rozhodcem, stávka na straně zaměstnanců a výluka na straně zaměstnavatele jako krajní prostředky řešení sporů o uzavření kolektivní smlouvy. Práce rovněž zahrnuje samostatnou kapitolu ohledně významných soudních rozhodnutí vztahujících se na tuto oblast. Následující kapitola je pak věnována právním úpravám řešení kolektivních sporů na Slovensku, v Polsku, Rakousku a Německu. Práce je završena návrhy na zlepšení stávající právní úpravy této problematiky.cs
dc.description.abstract-translatedThe theme of this thesis is the resolution of disputes under the Act on Collective Bargaining. Its aim is especially to give a comprehensive interpretation of this issue. The thesis describes collective labour law, collective bargaining including its subjects which are mainly the representatives of employees (trade unions) and their employers or their associations and collective disputes which arise in the context of collective bargaining. This thesis is also focused on individual specific ways of the resolving of collective disputes and each of them is devoted to separate chapters. These specific ways of resolving of collective disputes are the intermediary, arbitration and employee strike and dismissal on the part of the employer which are the last means of resolving a dispute over the conclusion of a collective agreement. The thesis also includes the separate chapter devoted to some of significant court decisions in this area. The following chapter describes the foreign legislation on the resolution of collective disputes with our closest neighbours - Poland, Germany, Austria and Slovakia. The thesis is completed with proposals and considerations to improve the existing legislation on this issue.en
