dc.description.abstractDiplomová práce pojednává o pozemkových služebnostech se zaměřením na pozemkové služebnosti umožňující přístup přes cizí pozemek. Věnována je zejména jednotlivým právním institutům upravujícím danou problematiku, ale pro přiblížení tématu práce je hovořeno obecně i o samotném pojmu služebnosti, jeho definici, zařazení v aktuální právní úpravě a způsobům vzniku a zániku služebnosti. Práce obsahuje i stručný historický vývoj právní úpravy služebností. Poté je již přikročeno k jednotlivým typům služebnostem, které právě umožňují přístup přes cizí pozemek. Kladen důraz je především na služebnost cesty a institut nezbytné cesty. Poslední část práce je soustředěna na další služebnosti, které také zahrnují právo přístupu přes cizí pozemek, ale toto oprávnění není hlavním účelem, proč dochází k jejich zřizování. Typicky se jedná o služebnost inženýrské sítě, právo na vodu, právo na sběr lesních plodů a právo pastvy. Práce má za cíl rozebrat příslušnou problematiku, zhodnotit její právní úpravu a vyvodit určité poznatky de lege ferenda.cs
dc.description.abstract-translatedThe diploma thesis deals with land servitudes with a focus on land servitudes allowing access through another person's property. It is mainly devoted to the individual legal institutes regulating the given issue, but in order to bring the topic of the thesis closer, the concept of servitude itself, its definition, its classification in the current legislation and the methods of creation and termination of the servitude are also discussed in general. The thesis also contains a brief historical development of the legal regulation of servitudes. It then proceeds to the individual types of servitudes that allow access through another person's property. The main attention is paid to the servitude of a way and the institute of a necessary path. The last part of the thesis is devoted to other servitudes, which also include the right of access over other people's land, but this authorisation is not the main purpose for which they are established. Typically, these are utility servitudes, water rights, rights to collect forest fruits and grazing rights. The aim of this thesis is to analyse the relevant issues, evaluate their legal regulation and draw some de lege ferenda conclusions.en
