dc.description.abstractDiplomová práce se názvem ?Věcněprávní prostředky zajištění pohledávky? se zaměřuje na současnou právní úpravu věcněprávních zajišťovacích institutů. Jednotlivé prostředky zde budou vymezeny a popsány tak, jak jsou v současné době upraveny v občanském zákoníku. Výklad bude podpořen judikaturou českých soudů. Bude zmíněn i jejich právní vývoj. Práce dále obsahuje popis právní úpravy věcněprávního zajištění podle obchodního zákoníku. Dále bude zmíněno, jakým způsobem se určuje právní řád státu v případě, že oběma stranami zajištěné pohledávky nebudou občané České republiky. Práce také bude obsahovat popis právní úpravy podle Nového občanského zákoníku.cs
dc.description.abstract-translatedTitle of the thesis is ?In rem instruments securing the liability?. Thesis will be composed of several parts. After the opening part will follow the part where the individual instruments of in rem securing will be named and briefly described. Third part of the thesis will be dedicated to the historical development of in rem instruments in the Czech Republic. Fourth part is the center of the thesis and it contains the main description of in rem instruments securing the liability. The individual instruments will be described here. Fifth part of thesis will be comparison between legislation of the Civil Code and legislation of the Commercial Code. Sixth part of my thesis will be dedicated to the description of securing legal relationships, where the sides of the relationship are not both citizens of one country. Last part of the thesis will be description of the in rem instruments securing the liability in the New Civil Code.en
