dc.description.abstractCílem této diplomové práce je objasnění pojmu souběhu trestných činů, jak je posuzován z hlediska právní teorie a praxe. Nejprve je nastíněná historie vývoje formy trestné činnosti (nebo jen souběhu), dále je tento pojem vymezen s ohledem na další formy pluralitní trestné činnosti, jako je recidiva a nepravá recidiva. Následuje vymezení pojmu skutku a rozdělení souběhu, případy zdánlivého souběhu a účinky pravého souběhu. Poté je důležitou kapitola o trestání souběhu trestných činů podle zásad a to dvěma formami trestu- úhrnným a souhrnným. Nakonec je zmíněno porovnání české a slovenské právní úpravy.cs
dc.description.abstract-translatedThe goal of this dissertation is to clarify term concurrence of criminal offenses, according to point of view of law theory and law practice. At first is outlined history of development of the form of that criminal activity and then is this term defined with consideration on different forms of plural punishable activities like relapse and fake relapse. Definition of term deed, separation of term concurrence, cases of apparent concurrence and effects of real concurrence follows. Chapter about punishment of concurrence of criminal offenses according to two kinds of rules is very important, too. A comparison of Czech and Slovak criminal law adjustment is mentioned at the end.en
