dc.description.abstractCílem práce je přehledné a úplné shrnutí dané problematiky tak, aby posloužilo jako fundovaná analýza. Práci tvoří sedm hlavních kapitol, které jsou dále řazeny na podkapitoly. V první kapitole je popsána podstata bezpečnostního sboru Policie ČR, její činnost a funkce. Druhá kapitola obsahuje stručný historický vývoj policie v Evropě a situaci po vzniku samostatného československého státu po roce 1918. Třetí kapitola se zaobírá objasněním pojmu pracovního poměru, který probíhá v soukromé sféře a je jakýmsi protikladem vůči veřejnému služebnímu poměru, ve kterém vykonávají službu policisté a dále jeho srovnáním se služebním poměrem. V následující, čtvrté kapitole jsou popsány pojmy státní služby a služebního poměru jako speciálního druhu státní služby a jeho kategorie. Pátý a šestý oddíl zahrnuje název diplomové práce, tedy vznik a ukončení služebního poměru a dále se mu věnuje. Uvádí předpoklady pro vznik, způsoby ukončení a rozvádí je. Poslední, sedmá kapitola obsahuje soudní rozhodnutí neboli judikaturu, kde je na několika případech vidět, jaké komplikace mohou s daným tématem vzniknout a jak je posoudila česká justice včetně mého osobního úsudku.cs
dc.description.abstract-translatedThe goal of this thesis is to create a clear and complex overview of this issue so it can be used as fundamental analysis. The thesis is consisting of seven main chapters, which are furthermore subdivided into subchapters. The first chapter describes the principle of Czech Police Department, its activities as well as functions. The second chapter contains a brief historic development of police force in Europe and particularly the situation after the inception of independent Czechoslovakia after 1918. The third chapter focuses on the definition of employment relation in private sector which is in essence a contradiction to employment in governmental sector the police officers are subjected to and resulting contrast of these two. In the following, fourth chapter there is a description of various terms of governmental service and employment as a special kind of service and its categories. Chapters five and six include the final thesis topic, the creation and termination of employment and they further explore it as such. It defines the premises for creation and termination of the employment and it investigates both. The last, seventh chapter contains the court's decision or judiciary rulings which are used as examples to demonstrate, what complications may arise in connection to the topic of this thesis and how the Czech courts ruled in these instances, as well as my subjective and personal opinions.en
