dc.description.abstractSmluvní pokuta je velmi důležitý právní institut v oblasti soukromého práva. Na začátku práce jsou zmíněny základní pojmy, které jsou se smluvní pokutou spjaty. Druhá kapitola je o postavení smluvní pokuty v římském právu a v zákonech 19. a 20. století platných na území českého státu. V následující kapitole jsou probrány formální a obsahové náležitosti smluvní pokuty. Ve čtvrté kapitole se práce zaměřuje na soudní moderaci. V závěrečných kapitolách je probrána akcesorita smluvní pokuty a v souvislosti s tím i postoupení pohledávky, také splatnost a promlčení smluvní pokuty a nakonec i vztah smluvní pokuty a úroku z prodlení.cs
dc.description.abstract-translatedThe Contractual penalty represents a high profile instrument for securing any type of obligation. In the beginning of the thesis are mentioned the essential concepts connected to the contractual penalty The second charter analyzes the position of the contractual penalty in Roman law and in legal acts of the 19th and 20th century which were in force on Czech state territory. The following chapter provides information on the formal and content requirements of the contractual penalty. In the fourth chapter the thesis provides informations on judicial moderation. In the final chapters accessory of contractual penalty and in connection to it undergoing of indebtedness, maturity and limitation of contractual penalty and relation of contractual penalty and interest form overdue are addressed.en
