| dc.description.abstract | Diplomová práce se zabývá především analýzou návrhů nového zákona o státním zastupitelství, které byly v posledních letech vypracovány. Autorka se zaměřuje na ty nejzásadnější změny, které zmíněné návrhy přinášejí. Potřebný kontext je zprostředkován exkurzem do historického vývoje organizace státního zastupitelství. Nechybí ani stručný popis stávající úpravy, která měla být uvedenými návrhy nahrazena. V něm je obsaženo ústavní a zákonné postavení státního zastupitelství, jakož i jeho postavení z hlediska dělby moci. Dále pak autorka pojednává o organizaci státního zastupitelství a vztahy v rámci jeho soustavy. Druhá polovina práce se pak zaměřuje na tři návrhy zákona, které byly v posledních letech vypracovány. Autorka popisuje a hodnotí hlavní změny, které by dle zmíněných návrhů měly ve státním zastupitelství nastat. Jsou jimi především zrušení Vrchních státních zastupitelství, zřízení speciálních orgánů či změny v postavení nejvyššího státního zástupce. Cílem práce je pak především nestranné posouzení navrhovaných změn a jejich zhodnocení. | cs |
| dc.description.abstract-translated | The diploma thesis is focused on the analysis of the proposed legislation concerning the Public Prosecutor's Office which has been lately drafted. The author deals with the main changes brought by the mentioned legislation. The needed context is mediated by the excursion to the historical development of the organization of the Public Prosecutor's Office. In the thesis there is also a description of the current statutory regulation which was supposed to be replaced. The description contains the constitutional and legal definition of the Public Prosecutor's Office and its definition in terms of the separation of powers. The thesis goes on with the description of the organization of the Public Prosecutor's Office and of the relationships within the system. The second half of the thesis is focused on the three drafts of the bill which have been submitted in last years. The author describes the main changes that have been proposed such as the cancellation of the High Public Prosecutor's Office, creation of a new Specialized Public Prosecutor's Office or changes in a position of the Supreme Public Prosecutor. The main purpose of the thesis is an impartial evaluation of the proposed changes. | en |
