dc.description.abstractNesezdané soužití jako alternativní forma soužití je fenoménem moderní doby. Obsah nesezdaného vztahu se v mnohém shoduje s institucionalizovanými formami soužití, de lege lata se mezi nimi však činí značný rozdíl. Hlavním cílem diplomové práce je podat komplexní výklad o právech a povinnostech nesezdaných párů. Práce se dále zaměřuje na otázku, jakou ochrnu poskytuje český právní řád osobám, které se nacházejí v nekodifikované formě soužití. Současně práce také poukazuje na podstatné odlišnosti mezi manželstvím, registrovaným partnerstvím a nesezdaným soužitím. Práce sleduje především soukromoprávní aspekty nesezdaného soužití, ale obsahuje také kapitolu věnovanou veřejnoprávní úpravě. Na závěr práce jsou uvedeny úvahy de lege ferenda ve světle právní úpravy evropských zemí.cs
dc.description.abstract-translatedCohabitation as an alternative form of partnership is a phenomenon of modern times. The content of unmarried relationships often overlaps with institutionalized forms of partnership, de lege lata there are significant differences between them. The main goal of this thesis is to provide a comprehensive analysis of the rights and obligations of unmarried couples. Furthermore, the thesis focuses on examining the protection provided by the Czech legal system to individuals in uncodified partnerships. Simultaneously, it highlights significant differences between marriage, registered partnership, and unmarried cohabitation. The thesis primarily addresses the private law aspects of unmarried cohabitation but also includes a chapter dedicated to public law regulation. In the last chapter, contemplations of de lege ferenda are presented in the light of the legislation of European countries.en
