| dc.description.abstract | Autor ve svém článku komentuje základní změny, které do kanonického trestního práv hmotného vnesla apoštolská konstituce papeže Františka Pascite gregem Dei ze dne 23. 5. 2021, který nabyde účinnosti dnem 8. 12. 2021. Po reformě manželského procesu v roce 2015 jde o druhou rekodifikaci celého subsystému kanonického práva po vydání CIC/1983. První část článku se týká vlastních změn v právní úpravě, v druhé části autor v úvaze de lege ferenda zmiňuje instituty trestního práva, které naopak novou právní úpravou nebyly dotčeny, jakkoliv by to bylo žádoucí. | cs |
| dc.description.abstract-translated | In his article, the autor comments on the fundamental changes introduced to the canon substantive criminal law by the Apostolic Constitution of Pope Francis Pascite gregem Dei of 23rd May 2021. After the reform of the matrimonial legal process in 2015, this is the second recodification of the entire canon law subsystem after the issuance of the CIC/1983. The first part of the article concerns the changes in the legislation itself, in the second part the autor mentions in the consideration de lege ferenda the institutes of criminal law, which, on the contrary, were non affected by the new legislation, however desirable. | en |
