Current Legal Issues of Training Artificial Intelligence Models on Copyrighted Data

Abstract

Artificial intelligence is a field in which computer programs, thanks to their intelligence, reproduce, among other things, the intellectual activity of a person. The emergence of artificial intelligence dates back to 1956, when it was introduced by J. McCarthy at a conference at Dartmouth College, New Hampshire. Creators of artificial intelligence models often use data protected by copyright to train and improve their artificial intelligence models. The paper analyses the issue of copyrighted data (works) used for training generative artificial intelligence models from the perspective of admissibility of using such data (works), remuneration belonging to their authors, and liability relationships. The paper includes the current legal status and considerations on the legal regulation de lege ferenda.

Umělá inteligence je oblast, v níž počítačové programy díky jejich inteligenci reprodukují, kromě jiných záležitostí, intelektuální aktivitu lidí. Vznik umělé inteligence se datuje rokem 1956, kdy byla představena J. McCarthym na konferenci v Dartmouth College v New Hampshire. Tvůrci modelů umělé inteligence často k trénování a zdokonalování těchto modelů užívají data, která jsou chráněna autorským právem. Příspěvek analyzuje otázky dat (děl) chráněných autorským právem, která jsou užívána pro trénování modelů generativní umělé inteligence z pohledu oprávněnosti užití takových dat (děl), odměny náležející autorům dat (děl) a otázky odpovědnosti. Příspěvek zahrnuje současné právní postavení a úvahy de lege ferenda.
