dc.description.abstractDiplomová práce se zabývá problematikou peněžitého trestu v českém trestním právu. Peněžitý trest patří mezi alternativní tresty, které mohou v mnoha případech účinně nahradit trest odnětí svobody kratšího trvání. Hlavním cílem práce bylo podat ucelený pohled na problematiku peněžitého trestu. Po úvodu následuje pojednání o historii peněžitého trestu, následující kapitola se zabývá systémem alternativních trestů. Součástí této kapitoly je i stručné vymezení pojmu trest. Čtvrtá kapitola tvoří stěžejní část této práce, neboť pojednává o platné právní úpravě peněžitého trestu. Jsou v ní vymezeny podmínky jeho ukládání či způsob jeho výměry. Následující kapitola pojednává o ukládání peněžitého trestu v praxi. V šesté kapitole jsem se zaměřila na srovnání se zahraniční právní úpravou a vybrala jsem si pro to Slovenskou republiku. Závěr shrnuje poznatky, které jsem v průběhu psaní této práce získala.cs
dc.description.abstract-translatedThis work focuses on financial fine in Czech legal system of punishments. Financial fine belongs to alternative punishments that can in many situations effectively substitute the shorter version of unconditional imprisonment. The main goal of my work is to present a complex view concerning the fine punishment. After introduction follows the chapter about history of fine punishment. The next part focuses on system of alternative punishments. To this topic is related the definition of the concept of punishment. The chapter four represents the essential part of this work, because of it analyses the actual legal codification of fine punishment. There are defined conditions of application of this sort of punishment or the way of the inflict. The next chapter presents the application of fine punishment in the praxis. In the chapter six I have focused on comparison of foreign legal regulations and I have chosen for this purpose the Slovakia. The conclusion collects the information that I have obtained during realisation of this work.en
