dc.description.abstractDiplomová práce se zabývá českou trestněprávní úpravou operativně pátracích prostředků - předstíraného převodu, sledování osob a věcí a použití agenta. Operativně pátrací prostředky jsou zde pozitivně i negativně vymezeny a dále jsou jednotlivě podrobně rozebrány, stanoveny podmínky jejich použití apod. Použití agenta je rozebráno i z hlediska praxe v trestním řízení, včetně definice policejní provokace a uvedení příkladu z praxe. Nakonec je česká právní úprava použití agenta srovnána se slovenskou právní úpravou. Cílem práce je vymezit platnou právní úpravu daného tématu, identifikovat její úskalí a navrhnout možná řešení, dotknout se otázky závažnosti tohoto tématu v praxi trestního řízení, jaké je uplatnění těchto prostředků a s jakými problémy při jejich aplikaci se v praxi můžeme setkat.cs
dc.description.abstract-translatedThe diploma thesis deals with the Czech criminal law regulation of the operational investigative means - sham transfer, surveillance of things and individuals, use of an agent. The operational investigative means are positively and negatively defined here, and are further analyzed in detail, including the conditions of their use, etc. The use of an agent is also analyzed in terms of practice in criminal proceedings, including the definition of police provocation and the introduction of a practical example. Finally, the Czech legal regulation of the use of an agent is compared with the Slovak legal regulation. The aim of the thesis is to define the legal regulation of the given topic, to identify its pitfalls and to propose possible solutions, to address the issue of the seriousness of this topic in practice, what is the use of these means and what problems we can encounter in practice.en
