dc.description.abstractMá práce se zabývá aktuální úpravou závěti podle zákona č. 89/2012 Sb., občanský zákoník. První část práce obsahuje obecné vymezení pojmu závěť a jeho zařazení do skupiny pořízení pro případ smrti. Dále zde nalezneme i základní požadavky na platnost jakékoliv závěti. Druhá část práce se věnuje formám závěti, které lze obecně klasifikovat na závěť soukromou listinou, veřejnou listinou a privilegované závěti. Třetí část práce je zaměřena na zrušení pořízené závěti, a to prostřednictvím pořízení nové závěti nebo odvolání závěti. Poslední část práce je věnována potomkům zůstavitele, kteří mají postavení nepominutelného dědice.cs
dc.description.abstract-translatedThe thesis deals with the actual legislation of testament by the act no. 89/2012 Coll., the Civil Code. The first part of the thesis defines a general definition of the testament and its inclusion in the group of disposition mortis causa. We can also find the basic requirements for the validity of any testaments. The second part of the thesis concerns the forms of testaments, which can be generally classified as testaments through private deed, testaments through public document and privileged testaments. The third part focuses on the cancellation of the testament, through making a new testament or cancellation of testament. The last part is dedicated to the descendants of the testator, who have the status of an a forced heir.en
