| dc.description.abstract | Diplomová práce se zabývá tématem veřejných stráží. V České republice se vyskytují čtyři druhy těchto stráží. Je to stráž rybářská, myslivecká, lesní a přírody. Dle svých názvů vykonávají stráže dohled a kontrolu v konkrétních oblastech. Stráž rybářská se stará o ochranu rybářství, myslivecká o ochranu myslivosti, lesní o ochranu lesů a stráž přírody dohlíží na ochranu přírody a krajiny. Na ochranu přírodního bohatství dbá i stát a proto svěřuje strážcům řadu oprávnění, aby mohli vykonávat svoje úkoly. Nejvíce takových oprávnění má stráž myslivecká. Strážce je fyzická osoba, která v konkrétně daných oblastech vykonává část veřejné správy. Každý strážce je ustanoven pro konkrétní část území. V případě stráže rybářské jde o revír, u stráže myslivecké je to honitba, u lesa jde o konkrétní lesní pozemek a u stráže přírody se jedná o konkrétní zvláště chráněné území. Každá stráž je při výkonu své činnosti povinna prokazovat se služebním průkazem a odznakem. Podmínkou pro ustanovení všech stráží je složení slibu, kterým se zaváží k plnění povinností vyplívající z jejich funkce. Všechny stráže jsou v případě porušování právních předpisů oprávněny k uložení pokuty na místě. Veřejné stráže nejsou upraveny v jednom zákoně, ale v jednotlivých zákonech, které komplexně upravují příslušnou oblast. Strážci mají při plnění svých úkolů postavení úředních osob, z čehož pro ně vyplývá zvýšená ochrana, ale také odpovědnost. | cs |
| dc.description.abstract-translated | This thesis deals with the topic of public guards. There are four types of these guards in the Czech Republic. It is a fishing, hunting, forest and nature guard. According to their names, the guards watch over and control specific areas. The fishing guard takes care of fishing regions, hunting guard watches over the hunting areas, forest guard oversees forests protection and nature guard takes care of nature and landscape protection.The state is also committed to protecting the natural wealth and therefore entrusts the guards with a number of privileges to perform their tasks. The most of these privileges has the hunting guard. The guardian is an individual who follows the public administration in specific areas. Every guardian is elected for a particular area. It is a fishing ground for the fishing guard, a hunting groud for the hunting guard, a specific forest land for the forest guard and a specific specially protected area for the nature guard. Each guard is obliged to prove his/her identity card and badge in the course of his/her activity. A precondition for the establishment of all guards is to make a promise to commit to their duties. In the case of breaking laws, the guardians can impose a fine. Public guards are not governed by one law, but by individual laws that comprehensively regulate the relevant area. The guardians have the status of civil servants. Therefore they have not just increased protection, but also increased responsibility. | en |
