dc.description.abstractTato diplomová práce podrobně pojednává o institutu poručenství. Poručenství je právním institutem, prostřednictvím něhož je nezletilému dítěti zajišťována právní ochrana zákonem povolanou nebo soudem jmenovanou osobou poručníka. Diplomová práce je rozdělena do šesti kapitol. Práce počíná historickým vývojem a nejdůležitějšími milníky zkoumaného institutu. Následně je práce zaměřena na současnou právní úpravu institutu poručenství. Práce pojednává o vzniku poručenství a důsledcích s tím spojenými, osobě poručníka, právech a povinnostech poručníka, dozoru soudu nad výkonem poručenské funkce a zániku poručenství. Autorka práce tak čtenářům poskytuje ucelený obraz o tomto institutu. Závěr práce je věnován komparaci české právní úpravy institutu poručenství s právními úpravami vybraných států, a to Slovenska, Francie a Kanady, konkrétně provincie Québec.cs
dc.description.abstract-translatedThis master thesis deals in detail with the institute of guardianship. Guardianship is a legal institute through which a minor is provided with legal protection by a guardian called by law or appointed by the court. The master thesis is divided into six chapters. The thesis begins with the historical development and the most important milestones of the researched institute. Subsequently, the thesis focuses on the current legal regulation of the institute of guardianship. The thesis deals with the origin of guardianship and the consequences of the institute, the person of the guardian, the rights and obligations of the guardian, the supervision of the court over the performance of the guardianship function and the termination of the guardianship. The author of the thesis thus provides readers with a comprehensive picture of this institute. The conclusion of the thesis is devoted to the comparison of the Czech legal regulation of the institute of guardianship with the legal regulations of selected states, namely Slovakia, France, and Canada, specifically the province of Quebec.en
