dc.description.abstractTato diplomová práce se zabývá opatřením obecné povahy v kontextu jeho soudního přezkumu v České republice, se zvláštním zřetelem na důvody, pro které může být tento institut v rámci správního soudnictví rušen. V úvodní části je vymezena materiální a formální povaha tohoto institutu jako specifického smíšeného správního aktu. Druhá část analyzuje proces soudního přezkumu podle soudního řádu správního se zaměřením na jeho nejdůležitější aspekty jako jsou aktivní a pasivní procesní legitimace nebo lhůta k podání příslušného návrhu. Stěžejní část práce pak systematicky rozebírá jednotlivé kroky algoritmu soudního přezkumu. Od zkoumání pravomoci a působnosti přes procesní postup až po hmotněprávní soulad a posouzení proporcionality. Práce rovněž reflektuje novou právní úpravu incidenčního přezkumu a sporné otázky týkající se nicotnosti opatření obecné povahy.cs
dc.description.abstract-translatedThis thesis examines measures of a general scope in the context of their judicial review in the Czech Republic, with particular emphasis on the reasons on which administrative courts may annul such measures. The introductory section defines the substantive and formal nature of this institution as a specific mixed administrative act. The second part analyzes the judicial review process under the Law on Administrative Procedure, focusing on its most important aspects, such as standing to sue and be sued, or the deadline for filing the relevant petition. The main body of the thesis then systematically examines the individual steps of the judicial review algorithm, ranging from the examination of jurisdiction and competence through procedural steps to substantive legal compliance and the assessment of proportionality. The thesis also addresses the new legal framework for incidental review and contentious issues regarding the nullity of measures of a general scope.en
