| dc.description.abstract | Předložená diplomová práce se zabývá problematikou náhrady škody a nároků poškozených v souvislosti s porušením vlastnických práv dle generální skutkové podstaty zavádějící odpovědnost za porušení zákona. Cílem práce je nejprve uvést přehled předpokladů vzniku nároku na náhradu škody, dále uvést způsoby její náhrady a její uplatňování s ohledem na institut promlčení, a nakonec způsoby stanovení rozsahu škody a s tím související stanovení rozsahu náhrady. Práce uvedenou problematiku analyzuje s ohledem na historický kontext, doktrinální výklad a přístup historické i současné soudní praxe. | cs |
| dc.description.abstract-translated | The presented diploma thesis examines the issue of compensation for damages and claims of victims in connection with the violation of ownership rights according to the general liability for violation of the law. The aim of the thesis is first to give an overview of the conditions for the establishment of a claim for compensation for damages, then to indicate the methods of compensation and its assertion with regard to the institute of the statute of limitations, and finally to describe the methods of determining the extent of damages and the related determination of the scope of compensation. The thesis analyses the aforementioned issues with regard to the historical context, doctrinal interpretation and the approach of historical and contemporary judicial practice. | en |
