dc.description.abstract-translatedThe plenary decision of the Czech Constitutional Court dated April 24, 2024, case no. Pl. ÚS 52/23, annulled the existing legal regulation of gender re- assignment as of June 30, 2025, in light of protecting the right to privacy for transgender individuals under Articles 7 and 10 of the Charter of Fundamental Rights and Freedoms of the Czech Republic. This means that as of the specified date, official gender reassignment will no longer require surgical intervention involving the permanent loss of reproductive function, as currently stipulated in Section 29 par. 1 of the Civil Code and Section 21 par. 1 of the Law on Specific Health Services. However, is it truly possible to achieve better protection of the right to privacy for transgender individuals, as anticipated by this decision of the Constitutional Court? Did the Constitutional Court of the Czech Republic adequately consider all aspects of the private lives of transgender individuals to ensure the appropriate protection of their rights? These, and other related questions, will be discussed and answered in this article.en
