dc.description.abstractTato diplomová práce se zaměřuje na problematiku trestných činů spáchaných proti životu a zdraví z nedbalostního zavinění. Cílem práce je analyzovat právní úpravu této oblasti v České republice, přičemž pokrývá definice trestných činů, historický vývoj právní regulace a judikaturu, která ovlivňuje současnou soudní praxi. Práce rozebírá klíčové pojmy jako nedbalost, zavinění a trestní odpovědnost, včetně odpovědnosti právnických osob. Specifické trestné činy jako usmrcení, těžké ublížení na zdraví či ohrožování zdraví z nedbalosti jsou analyzovány s důrazem na praktické důsledky právní úpravy a identifikaci jejích slabin. Autor také navrhuje možné legislativní změny, které by mohly podpořit efektivnější postih a prevenci nedbalostních trestných činů, zejména v oblastech dopravy a zdravotnictví. Tato práce nabízí komplexní pohled na ochranu základních hodnot, života a zdraví, a přispívá k diskuzi o budoucích směrech trestního práva.cs
dc.description.abstract-translatedThis thesis focuses on the issue of crimes against life and health committed through negligence. The aim of the thesis is to analyse the legal regulation of this area in the Czech Republic, covering the definitions of crimes, the historical development of the legal regulation and the case law that influences the current judicial practice. The thesis analyses key concepts such as negligence, fault and criminal liability, including the liability of legal persons. Specific offences such as manslaughter, grievous bodily harm and negligent endangerment are analysed with an emphasis on the practical implications of the legislation and the identification of its weaknesses. The author also suggests possible legislative changes that could promote more effective punishment and prevention of negligent crimes, especially in the areas of transport and health care. This work offers a comprehensive view of the protection of fundamental values, life and health, and contributes to the discussion of future directions for criminal law.en
