dc.description.abstractTato diplomová práce se zabývá problematikou ochrany lidského plodu z pohledu trestního práva. Jejím cílem je odpovědět na otázku, zda a v jaké míře poskytuje trestní právo ochranu lidskému plodu. Úvodní část práce se věnuje právní subjektivitě plodu s ohledem na biologické, bioetické a filozofické přístupy, a rovněž krátce pojednává o právu plodu na život ve vztahu k právu matky.<br>Hlavní část práce analyzuje trestněprávní ochranu těhotenství ženy v kontextu současné i historické právní úpravy a srovnání s legislativou vybraných evropských zemí. Klíčovým tématem je určení počátku právní ochrany lidského plodu a jeho právní subjektivity.<br>Z pohledu českého právního systému není lidský plod subjektem práv, nemá právní osobnost a je chráněn pouze jako součást těla matky. Trestněprávní ochrana zdraví plodu zcela chybí.<br>Závěrečná část práce se proto věnuje úvahám de lege ferenda o možné budoucí právní úpravě.cs
dc.description.abstract-translatedThis thesis deals with the issue of protection of the human fetus from the perspective of criminal law. It aims to answer the question whether and to what extent criminal law provides protection to the human foetus. The introductory part of the thesis deals with the legal personality of the fetus with regard to biological, bioethical and philosophical approaches, and also briefly discusses the right to life of the fetus in relation to the right of the mother.<br>The main part of the thesis analyses the criminal protection of a woman's pregnancy in the context of current and historical legislation and comparison with the legislation of selected European countries. The key topic is the determination of the beginning of the legal protection of the human fetus and its legal personality.<br>From the perspective of the Czech legal system, the human foetus is not a subject of rights, it has no legal personality and is protected only as a part of the mother's body.
