dc.description.abstractPředmětem diplomové práce je odposlech a údaje spojené s užíváním telekomunikačních prostředků, to znamená velmi aktuální a diskutované instituty trestního práva. Bezesporu můžeme říci, že odposlech jednoznačně přispívá k odhalování trestných činů a tím pádem dopomáhá k ochraně společnosti. Na druhou stranu použití odposlechu a záznamu telekomunikačního provozu znamená poměrně značný zásah do osobnostních práv, garantovaných Ústavou České republiky. Je potom zcela na orgánech činných v trestním řízení jak se s touto situací vypořádají a do jaké míry zásah do lidských práv odůvodní.cs
dc.description.abstract-translatedThe subject of the diploma thesis is wiretap and data connected with the use of telecommunication means, which are very up-to-date and discussed criminal law institutes. Undoubtedly, it can be said that wiretapping clearly contributes to the detection of criminal offenses and thus helps to protect society. On the other hand, the use of wiretapping and recording of telecommunication traffic means relatively considerable interference with the personal rights guaranteed by the Constitution of the Czech Republic. It is then entirely in the law enforcement bodies how to deal with this situation and the extent to which the interference with human rights will be justified.en
