dc.description.abstract-translatedThe concept of the injured party‘s mandatory level of caution was known to jurisprudence in the Slovak Republic even before 1938, while at the moment we mean the injured party‘s obligation to comply with the obligation established in § 415 of the Civil Code. According to the nature of the matter, respectively the subject, it is necessary to comply with the obligations also according to the paragraphs regulated in special laws. The mandatory degree of caution is examined through objective and subjective criteria. Failure to observe the mandatory level of caution results in failure to fulfill the causal nexus in the crime of fraud (and its special forms), as a result of which, it is not possible to establish criminal liability against that person for their fraudulent actions. The modification of the concept of the mandatory level of caution of the injured party is represented by the permissible level of business risk. When it is no longer an admissible level of business risk, we can derive it from the violation of a particular obligation imposed on the entrepreneur by a special legal regulation or through the „business judgment rule“. However, it is worth reminding that each case needs to be assessed individually with the rule of interpretation of the principle of subsidiarity of criminal repression, which is also not absolute. In conclusion, it can be added that in the selected application practice of the prosecutor‘s office in Slovak republic, we had the opportunity to observe the correct application of this concept, whether with business or other subjects of law, and thus there are no different decisions on similar cases, so the predictability of the law and thus the principle of the rule of law is preserved.en
