dc.description.abstract-translatedThis paper deals with the issue of incompatibility of the functions of a municipal representative from the perspective of the guarantee of fundamental human rights. Act No. 491/2001 Coll. significantly restricts the right of employees of designated municipal authorities, regional authorities and financial authorities and appointed senior public administration employees to equal access to elected public offices, specifically the public office of a member of a municipal council. In my view, the current legislation is constitutionally uncomfortable, discriminatory, unreasonable and objectively untenable. It undesirably restricts the fundamental rights and freedoms of certain employees in a state governed by the rule of law, which is very risky for a society that has experienced a totalitarian form of government. In its real effect, the above has a very negative impact on the development of municipalities in the Czech Republic. Act No 491/2001 Coll. should be amended in the manner described in section 7 of this paper.en
