| dc.description.abstract-translated | The specificity of the working conditions lies in the place of work performance, change of job classification, disciplinary responsibility, remuneration, as well as the end of work performance. When negotiating working conditions, the principle of contract is absent and the element of duplication is clearly manifested. Despite these particularities, the work performance of convicts shows all the elements of dependent work. Both the accused and the convicted perform dependent work, according to the degree of complexity, effort and responsibility, just like employees in an employment relationship. It is not clear why the basic wage does not corre spond to the minimum wage, and the Minimum Wage Act does not apply to the performance of such dependent work. It is necessary to emphasize that, for example, maintenance is deducted from the amount in question for persons who are dependent on the income of the convicted person. The algorithm for calculating maintenance from the work remuneration of a convicted person is significantly different from the algorithm for calculating maintenance from the remuneration for the work performed by an employee. We should not neglect the relevant fact that products and services that are the result of the work performed by convicts are provided to customers for a fee and represent income for the state budget.
