| dc.description.abstract | Tato diplomová práce se zabývá příkazní smlouvou (mandatum) v římském právu a jejími podtypy. Práce nejprve zasazuje mandát do širšího rámce římského závazkového práva, poté podrobně analyzuje jeho vznik, obsah, zánik, práva a povinnosti obou smluvních stran i související žaloby. Zvláštní pozornost je věnována teoretickým aspektům, jako jsou bezúplatnost a fiduciární charakter mandátu, a dále systematickému rozboru jednotlivých podtypů, včetně specifického mandatum qualificatum jako předchůdce moderních zajišťovacích institutů. Závěrečná část sleduje recepci mandátu ve středověkém, novověkém i moderním právu a jeho vliv na současnou českou právní úpravu. Cílem práce je ukázat mandát jako flexibilní právní nástroj, který díky spojení právních a etických principů významně ovlivnil vývoj evropských závazkových systémů. | cs |

It first situates the mandate within the broader framework of Roman obligations, explaining its legal nature, fiduciary character, and ethical foundation grounded in fides and amicitia. The thesis provides a detailed analysis of the formation, content, and termination of mandatum, including the rights and duties of both parties and the procedural protection ensured by actio mandati directa and contraria. Special attention is devoted to the theoretical aspects of the contractparticularly its gratuitous natureand to a systematic overview of individual subtypes, such as the economically significant mandatum qualificatum. The concluding part explores the reception and transformation of the mandate in medieval, early modern, and contemporary legal systems, with emphasis on its reflection in Czech civil law. The thesis shows that mandatum was a flexible and adaptable legal instrument whose principles have significantly influenced the development of European private law and remain relevant in modern contractual practice. | en |
