dc.description.abstract-translatedThe corrective of good morals is one of the vague legal concepts, thus it is a concept that is not defined in the legal system. For this reason, case law is of great importance, which defines the basic limits of its application in judicial practice. In this article, the author assesses the conditions that must be met in order for this corrective to be applied. She concludes that the case law understands this corrective as an excep tional institute serving to eliminate the disproportionate harshness of the law. It is not permissible for the application of this corrective to lead to a weakening of legal certainty and the protection of the parties‘ subjective rights conferred by law. Courts assessing the possibility of its application must always consider all the circumstances of the case and apply this corrective only if the findings of fact justify its application.en
