dc.description.abstractCílem práce bylo porovnání právního rámce pro řízení operačního rizika v bankách a pojišťovnách v souvislosti s implementací mezinárodních standardů pro řízení operačních rizik do právního řádu České republiky. Práce vychází: - z analýzy regulí souvisejících s řízením operačního rizika u bank a pojišťoven, analýza je zaměřena na hard law a soft law a jejich závaznost a vynutitelnost související s řízením operačního rizika, - z analýzy subjektů, kteří se podílejí na regulaci a dohledu, zaměřené na jejich regulatorní a dohledové činnosti, práva a povinnosti. - Obsahová analýza je zaměřena na vymezení pojmu operačního rizika, odpovědností za řízení operačního rizika, nástroje řízení operačního rizika, povinný reporting. Zabývala jsem se vlivy ?corporate governance? na operační riziko a jeho řízení. - Analýza zohledňuje historický vývoj pouze okrajově, spíše je zaměřena na aktuální situaci a předpokládaný vývoj. Zkoumaná problematika má interdisciplinární charakter, proto se ve své práci zabývám nejen právními, ale i ekonomickými otázkami. Práce je zaměřena na rozdíly v regulaci, harmonizaci, rozdíly v současné právní úpravě související s operačním rizikem a jeho řízením pro banky a pojišťovny, zhodnocení implementace mezinárodních doporučení a směrnic do českého právního řádu.cs
dc.description.abstract-translatedThis contribution is focused on regulatory and supervisory framework of operational risk management for banks and insurance companies. I work with the widely used definition for Operational risk, which created Basel Comittee for the purposes of identifying, monitoring, measuring, evaluating of risk, which is resulting from operations. ?Operational risk is the risk of loss resulting from inadequate or failed internal processes, people and systems, or from external events. I analyzed the influence of internal corporate governance and control mechanism on operational risk, I also analyzed different approaches for the operational risk management in relation to function of internal auditing and function of compliance. I described capital formation for operational risk, basic and special approaches, the role of the instance on the amount of min. capital requirement. I described Lamfalussyho procedure and its changes. I analyzed the role of new European supervisory authorities and the role of the Czech central bank in the operational risk managemenent. The European supervisory authorities have new power. They have legal subjectivity, they can create law were they have authorization from european law, they can create implementation and regulatory standards, they can make administrative decisions. I analyzed soft law and hard law and its implementation and enforcement, the way how the recommendations and best practices and general sound principles come in force. I analyzed princip comply or explain. I described difference between regulation and supervision.en
