dc.description.abstract-translatedIn this paper the author reflects on the nature of the general clause of unjustified enrichment and subjects the prevailing opinion originating in socialist law to a critical analysis. On the basis of doctrine and comparative research, the author tries to explain what theoretical and especially practical problems the prevailing opinion currently causes and tries to justify why the Slovak general clause of unjustified enrichment should be considered a directly applicable legal norm.en
