| dc.description.abstract-translated | The case of Moraru and Marin v Romania concerned discrimination on grounds of sex and age in the context of employment in the public administration. The violation occurred because women could not work until the same age as men. This violation was also referred to by the Romanian Constitutional Court in the case of differential determination of age under the Romanian Labour Code. The ECtHR found that there was discrimination in this case. In the conditions of the Slovak Republic, we have a provision in the Civil Service Act which legally terminates the civil service relationship with an employee upon reaching the age of 65. Such a provision should have also been in the Labour Code, but the Constitutional Court suspended such wording in the Labour Code. Both Slovakia and Romania argued in Moraru and Marin v. Romania that the setting of retirement conditions pursued a legitimate aim namely, to reduce unemploy- ment and to employ young people. However, the legitimate objective thus set can be achieved in other ways than by setting a retirement age of 65. | en |
