dc.description.abstract-translatedMy paper deals with the non-pecuniary damage suffered in a work injury and analyses the previous double-track legal regulation, which was and still can be reflected in the amount of compensation for non-pecuniary damage for the impairment of social performance, which occurred both in a work injury and in everyday life, i. e. outside the performance of work duties. The dual approach in this area advocated by the general courts had to be addressed in its decisions by the Constitutional Court of the Czech Republic, and its decisions, together with the Supreme Court‘s Methodology for Compensation for Non-Material Injury to Health, which are not direct sources of law, were thus reflected in the activities of the legislature, albeit „only“ in a sub-legislative regulation. Although the undesirable situation of a dual approach to compensation for non-pecuniary damage has already been eliminated by the legislator, there are still disputes to which the previous regulation will have to be applied and a purely grammatical interpretation could lead to its misinterpretation.en
