dc.description.abstract-translatedIn the following text, I focus on the issue of assessing judicial impartiality in cases where judges provide comments to the media on non-final decisions in pending cases. Courts, motivated by a concern not to undermine the image of the judiciary in the eyes of the public, apply relatively strict standards to media-open judges in such cases. On the grounds of a critical analysis of selected relevant case law, I show why it is necessary to distinguish and consider more leniently situations where a judge comments only on his or her own decision, even if subsequently overturned by a higher instance. In the paper, I also doubt whether the intended goal of maintaining and strengthening public confidence in the judiciary can be effectively achieved by suppressing judges’ efforts to explain their decisions to the public. Instead, I try to demonstrate where the benefits of the opposite approach lie.en
