dc.description.abstractCílem této diplomové práce zabývající se vybranými aspekty evropského spotřebitelského práva je popis a analýza především těch vybraných aspektů, které se týkají modernizace spotřebitelského acquis. Mezi tyto patří (i) vymezení evropského spotřebitelského práva a spotřebitele, (ii) procesní aspekty ochrany spotřebitele, (iii) geoblokování, (iv) dvojí kvalita zboží a (v) vliv GDPR na spotřebitelský marketing. Ochrana spotřebitele je v rámci evropského práva na relativně vysoké úrovni, avšak nebylo tomu tak od počátků evropské integrace. Spotřebitel není chráněn jen skrze spotřebitelskou politiku, ale též některými právními instituty, které se váží k vnitřnímu trhu. Současnou výzvou stojící před další ekonomickou integrací je konsolidace vnitřního trhu ve vztahu k oblasti digitálních služeb. Za jeden z nástrojů k využití plného potenciálu vnitřního trhu může být nová evropská regulace týkající se geoblokování. Mezi další významné opatření k posílení práv spotřebitelů lze zařadit zákaz zdvojování kvality produktů a též částečně nový právní institut zástupných žalob. Zástupné žaloby jsou důležité pro posílení ochrany spotřebitele v procesněprávní oblasti, kterou lze v současné době považovat za nedostatečnou. Lapidární zájem evropské politické reprezentace v posílání postavení spotřebitele je zřetelný, avšak zda budou tyto ambiciózní cíle naplněný se teprve ukáže.cs
dc.description.abstract-translatedThe aim of this Diploma Thesis titled Selected Aspects of the European Consumer Law is description and analysis especially of those selected aspects that are linked to the modernisation of the consumer acquis. Between these aspects belong (i) definition of the European Consumer Law and consumer,(ii) procedural aspects of the consumer protection, (iii) geo-blocking, (iv) dual quality of goods and (v) influence of the GDPR on the consumer marketing. The consumer protection is relatively within the European Union on the high level, however this has not been the case in the prior years of the European integration. The consumer is not protected only by the specific consumer protection policy but also by some of the legal institutes linked to the European Single Market. The challenges standing in front of the further European economic integration are to consolidate the Single Market in the digital area. As a remedy for the full use of the potential of the Single Market can be considered new European regulation regarding geo-blocking. Furthermore, other important initiatives concerning consumer protection is the ban of the dual quality of goods and partly new legal institute of representative actions. The representative actions are important in enhancing consumer protection in the procedural sphere which is to be considered as insufficient. The primary interest of the current European political representation in strengthening the consumer position is clear, however it is to be seen whether these regulations can fulfil such ambitious goal.en
