dc.description.abstractTato diplomová práce je komplexním zpracováním problematiky materiálního ohniska ústavnosti. Pojmu, jehož obsah tvoří základní hodnotové principy a metapravidla demokratického právního státu a jejichž změna či odstranění z právního řádu je nepřípustná. Práce se zabývá historickými a právně-filosofickými východisky tohoto pojmu. Současně provádí komparaci konceptu materiálního ohniska ústavnosti v různých evropských demokratických právních státech. Stěžejní část je věnována analýze ústavní podoby materiálního ohniska ústavnosti v právním řádu České republiky. V ní je provedena konkretizace obsahu podstatných náležitostí demokratického právního státu a rozbor ústavního postavení a důsledků zakotvení imperativu nezměnitelnosti v čl. 9 odst. 2 Ústavy. Autor vychází zejména z doktrinárních stanovisek a judikatury Ústavního soudu České republiky týkající se ochrany materiálního ohniska ústavnosti. V této souvislosti je podrobně rozveden a rozebrán nález Ústavního soudu sp. zn. Pl. ÚS 27/09.cs
dc.description.abstract-translatedThis thesis is a complex elaboration of the issue of the Substantive Heart of the Constitution. The content of this concept is formed by the fundamental principles and meta-rules of the democratic legal state and their change or removal of legal order is inadmissible. The thesis deals with historical and legal-philosophical views of this issue. It concurrently provides a comparison of the Substantive Heart of the Constitution in different European democratic legal states. The crucial part of this thesis handle the analysis of the constitutional form of the Substantive Heart of the Constitution in the Czech legal order. This section concretizes the content of essential requisites of democracy and rule of law and it analyses the constitutional status and the consequences of the imperative of unchangeable provisions of the constitution in the Art. 9 para 2. The author draws especially from the discursive opinions and judicial decisions of the Constitutional Court of the Czech Republic regarding the protection of the Substantive Heart of the Constitution. In this context the decision of the Constitutional Court Pl. ÚS 27/09 is discussed in detail.en
