dc.description.abstract-translatedOne of the fundamental objectives of the EU is the creation of an internal market, which is implemented both through the exclusive competence of the Union to lay down the competition rules necessary for the functioning of the internal market and, at the same time, through the competence in the area of the internal market that the Union shares with the Member States. In order to ensure the functioning of the internal market, and in particular in order to establish and secure the internal market across the Member States, the EU adopts measures to approximate the provisions of the laws, regulations and administrative provisions of the Member States, the aim of which is to achieve the right balance between achieving a high level of consumer protection and supporting the competitiveness of businesses. At the turn of the millennium, the Commission initiated the creation of a Common Frame of Reference, which was to provide clear definitions of legal concepts, basic principles and coherent model rules of contract law building on the EC acquis and on the best solutions found in the legal systems of the Member States. However, the situation is completely different today and, instead of implementing the intention to harmonise the substantive private law of the Member States through the adoption of common rules of contract law, a targeted harmonisation of specific contractual relationships has been pursued without reference to the original idea of common contractual rules and principles. Historical, social and economic differences between the individual institutes of the national substantive contract law of the Member States are currently amplified by the legislative freedom of the individual Member States, which has been given to them through minimum harmonisation. Such deepened differences cannot be eliminated by the complete harmonisation of only some cross-border legal relationships. In this respect, now, more than in the past, there is a need to eliminate the aforementioned differences in substantive contract law through clear definitions of legal concepts, basic principles and interconnected model rules of contract law, as presented in the draft Common Framework of Reference.en
