| dc.description.abstract | Základním účelem tohoto pojednání je strukturovaný a systematický popis právní problematiky spojené s agendou jednání mající znaky přestupku příslušníků Hasičského záchranného sboru České republiky (hasiče), vývoje právní úpravy, popis vedení řízení podle úpravy de lege lata a i de lege ferenda. Základním cílem tohoto příspěvku je popisné, systémové a komparativní posouzení vývoje a případné nutnosti novelizace právních institutů obsažených v zákoně o služebním poměru pro jednání mající znaky přestupku a návrhy de lege ferenda pro jednoznačnější vymezení potřebnosti či nepotřebnosti těchto institutů především ve zvláštním právním předpise s ohledem na obecnou právní úpravu. Zejména se jedná o popis vývoje této právní úpravy s popisem a praktickými zkušenostmi ze současnosti a návrhy do budoucna. | cs |
| dc.description.abstract-translated | The basic purpose of this paper is to provide a structured and systematic description of the legal issues related to the agenda of acts punishable as misdemeanors (přestupky) committed by members of the Fire and Rescue Service of the Czech Republic (firefighters), the development of legal regulations, and a description of the conduct of proceedings under de lege lata and de lege ferenda regulations. The basic objective of this paper is a descriptive, systemic, and comparative assessment of the development and possible need to amend the legal institutions contained in the Act on Civil Service for acts constituting misdemeanors, and de lege ferenda proposals for a clearer definition of the (un)necessary nature of these institutions, primarily in a special legal regulation with regard to general legal regulations. In particular, it describes the development of this legal regulation, with a description and practical experiences from the present and proposals for the future. | en |
