dc.description.abstractPráce se zabývá pohledem na rodinný a soukromý život z pohledu domácího porodu a jeho zakotvení v rámci české vnitrostátní úpravy rozvíjející úpravu ústavní. Práce se zaobírá nejdůležitějšími právními dokumenty a předpisy spolu s názory odborníků na toto téma a vytváří závěry, či shrnutí momentální situace v rámci platného a účinného českého práva. Provedenou studií vyvstal závěr o složité situaci pro poskytování péče domácího porodu v rámci současné právní úpravy ze strany zdravotnického personálu a ještě složitější situaci matek, potažmo rodičů, v možnostech naplnění práva na soukromý a rodinný život. Výsledným zhodnocením možností autor dochází k závěru, že právní úprava upřednostňuje práva dítěte, i když nezabraňuje naplnění práv matky. Tím, že je však matka využije, může narušit práva dítěte.cs
dc.description.abstract-translatedThe work deals with the view of family and private life from the perspective of a home birth and its inclusion within the Czech national legislation emerging institutional adjustment. The thesis deals with the most important legal documents and regulations, together with the views of experts on the subject and makes conclusions and a summary of the current situation within the valid and effective Czech law. By the conducted study have raised the conclusion of a difficult situation for the provision of care of home birth under the current legislation on the part of medical personnel and even more complex situation of mothers, by extension both parents, the possibilities of fulfilling the right to private and family life. The last decisions of an author concludes that the legislation favors the rights of the child, even if not prevent fulfillment of the rights of the mother. By fulfilling rights of mother, she may infringe the rights of the child.en
