| dc.description.abstract | Diplomová práce se zabývá institutem služebností z pohledu římského i aktuálního práva. Římskému právu je věnována první kapitola, která pojednává o všech významných aspektech tohoto institutu včetně jeho historického vývoje. Druhá část této práce je věnována aktuální právní úpravě služebností a jejímu zhodnocení. Bez povšimnutí nezůstává ani kontext vývoje moderního soukromého práva na území dnešní České republiky. Vzhledem k tomu, že je zde v mnohém čerpáno z judikatury, nalezneme zde i poznatky vhodné pro potřeby aplikační praxe. Třetí kapitola se zaměřuje na komparaci vybraných problémů římského a aktuálního práva. Předmětem srovnání jsou jak obecné charakteristiky těchto právních řádů, tak i zcela konkrétní instituty. Cílem práce je tedy analyzovat právní úpravu služebností dle římského i českého práva, srovnat vybrané aspekty tohoto institutu z pohledu uvedených právních řádů a v neposlední řadě zhodnotit míru ovlivnění aktuálního občanského zákoníku římským právem. | cs |
| dc.description.abstract-translated | The thesis deals with the institute of servitude from the point of view of both Roman and current legal systems. The first chapter is dedicated to Roman law and discusses all the important aspects of this institute including its historical evolution. The second part of this thesis pays attention to current servitude legislation and its evaluation. The context of the evolution of modern private law in the Czech Republic is not left unnoticed either. Given the fact that the thesis often draws from the judicature, we can find knowledge applicable in practice too. The third chapter focuses on the comparison of selected problems of Roman and current legal systems. Both general characteristics and specific institutes of these two legal systems are the subjects of the comparison. The aim of the thesis is thus to analyze the servitude legislation according to the Roman and Czech law, to compare the selected aspects of this institute from the point of view of the above-mentioned legal systems, and last but not least to evaluate the degree of influencing of the current civil code by Roman law. | en |
