dc.description.abstractTato diplomová práce je věnována Úmluvě OSN o smlouvách o mezinárodní koupi zboží, což je přímá norma mezinárodního práva, která reguluje kupní smlouvu s mezinárodním prvkem. První část této práce je zaměřena na vymezení Úmluvy v kontextu mezinárodního práva a na historický vývoj unifikace mezinárodního práva obchodu. Druhá část této práce je zaměřena na ratifikaci, aplikaci a interpretaci Úmluvy v souvislosti s vhodností Úmluvu v praxi na obchodní vztahy smluvních stran aplikovat. Třetí část této práce popisuje hmotněprávní jádro Úmluvy, ve kterém jsou obsažena pravidla uzavírání kupních smluv v režimu Úmluvy a práva a povinnosti smluvních stran. V celé práci jsou kriticky hodnoceny výhody a nevýhody Úmluvy.cs
dc.description.abstract-translatedThis thesis is about the United Nations Convention on Contracts for the International Sale of Goods, which is a norm of international law, which regulates the contract of sale with an international element. The first part of this thesis is focused on defining the Convention in the context of international law, and it is also describing historical development of unification of the international business law. The second part of the thesis is focused on ratification, application and interpretation of the Convention in connection to suitability of its application in practice on the contract of sale. The third part of this thesis is describing the substantive law part of the Convention, which contains rules for contract formation, as well as rights and obligations of contracting parties. In the whole thesis, advantages and disadvantages of the Convention are critically assessed.en
