dc.description.abstractCílem diplomové práce je vyložit klíčové instituty a objasnit účel Haagské Úmluvy o občanskoprávních aspektech mezinárodních únosů dětí z roku 1980 (dále jen jako "HÚ 1980"). V práci se zaměřím na vymezení pojmů této mezinárodní úmluvy s důrazem na přiblížení jejich výkladu v judikatuře. Dále je účelem diplomové práce popis činnosti Úřadu pro mezinárodně právní ochranu dětí v Brně, jakožto ústředního orgánu, a roli soudního řízení pohledem českého právního řádu v rámci návratového řízení. Za účelné považuji v závěru diplomové práce poskytnout krátký vhled do aplikační praxe vybraných členských států. Diplomová práce obsahuje také krátké pojednání o mezinárodních únosech s ohledem na historické okolnosti přijetí této mezinárodní smlouvy. Téma diplomové práce jsem si zvolil na základě osobního zájmu k materii.cs
dc.description.abstract-translatedThe aim of this thesis is to explain the key institutes and clarify the purpose of the Hague Convention on the Civil Aspects of International Child Abduction of 1980 (hereinafter referred to as "HC 1980"). The thesis will focus on defining the terms of this international convention, with an emphasis on clarifying their interpretation in case law. Additionally, the purpose of this thesis is to describe the activities of the Office for International Legal Protection of Children in Brno, as the central authority, and the role of judicial proceedings under the Czech legal system within the return procedure. In the conclusion of the thesis, I consider it useful to provide a brief insight into the application practices of selected member states. The thesis also includes a short insight on international child abductions in relation to the historical context of the adoption of this international treaty. I chose the topic of this thesis based on my personal interest in the subject matter.en
