Abstract

Tématem článku je náhrada škody za omezení podnikání způsobená krizovými opatřeními. Článek se nejprve zabývá v obecné rovině právem podnikat, dále popisuje, jakým způsobem může být toto právo omezeno, zejména podle krizového zákona, a shrnuje nouzový stav a krizová opatření. Hlavním zaměřením článku je náhrada škody způsobená krizovými opatřeními a v této souvislosti článek rozebírá zásadní judikaturu vztahující se k dané problematice.The topic of the article is compensation for business restrictions caused by crisis measures. The article first discusses the right to do business in general terms, then describes how this right can be restricted, in particular under the Crisis Act, and summarises the state of emergency and crisis measures. The main focus of the article is on compensation for damage caused by crisis measures and in this context the article discusses the main case law relating to this issue.
