dc.description.abstract-translatedThe decisions of the Constitutional Court of the Slovak Republic analyzed in the article (IV. ÚS 401/2024 and III. ÚS 394/2024) emphasize the principle of subsidiarity, according to which the protection of the suspect‘s rights and the fairness of the process are primarily the task of general courts and law enforcement authorities. The Constitutional Court intervenes only in case of failure of these mechanisms. It also confirms that the suspect‘s rights are limited by law and do not include e.g. mandatory defense that belongs to the accused. These decisions enhance the effectiveness of criminal proceedings and provide guidelines for interpreting the legal status of suspectsen
