Povaha cesty v archaickém římském právu

Abstract

Text se věnuje několika aspektům vývoje cesty a práva cesty v pramenech římského práva, a to především s ohledem na archaické období. V tomto smyslu se opírá nikoliv pouze o rekonstrukce textů Zákona dvanácti desek, ale přímo o prameny, které vedou k finálnímu textu oněch rekonstrukcí, a věnuje se i problematice výkladu některých pojmů, jejichž obsah není zcela zřejmý a jejichž ne každý výklad je odpovídající právě archaické době. V důsledku těchto úvah také text nabízí určité technické proposice pro to, jaký charakter by cesta v archaické době mohla mít, a tím například také nastiňuje její užívání.

The text examines several aspects of the development of the institute of road and the right of way in the sources of Roman law, especially with regard to the archaic period. In this sense, it relies not only on the reconstructions of the texts of the Laws of the Twelve Tables, but directly on the sources that lead to the final text of those reconstructions, and it also addresses the issue of the interpretation of some concepts whose content is not entirely clear and whose interpretation is not always appropriate to the archaic period. As a consequence of these considerations, the text also offers some technical propositions for the nature of the road in the archaic period and thus, for example, outlines its use.
