dc.description.abstractTato diplomová práce pojednává o soudní moci v České republice a pojetí nezávislosti v komparaci se Spolkovou republikou Německo. Na začátku vysvětluje jednotlivé pojmy, jako jsou dělba moci, soudní moc a nezávislost. V další části se pak zabývá organizací soudní moci v ČR a detailně se pak věnuje zejména soudní soustavě a jednotlivým soudům, soudcům a dalším soudním osobám. Obsahuje i současnou správu soudů v souvislosti s dosavadní neexistencí Nejvyšší soudcovské rady. Současně Dále obsahuje pojetí nezávislosti a poukazuje na jednotlivé záruky, které mají zajistit nezávislé rozhodování soudů i soudců. Patří mezi ně zejména jmenování soudce, požadavky na soudce, a další. Diplomová práce se zároveň zabývá organizací soudní moci a pojetím nezávislosti v SRN. To je pak komparováno s organizací soudní moci a pojetím nezávislosti v České republice. Práce zároveň obsahuje návrh možných východisek současných problémů, týkajících se udržení nezávislého rozhodování do budoucna.cs
dc.description.abstract-translatedThis thesis deals with the judicial power in the Czech Republic and the concept of independence in comparison with Germany. In the beginning explains the different terms, such as the division of power, judicial power and independence. The next section deals with the organization of the judiciary in the Czech Republic and then deals in detail with the judicial system, courts, judges and other judicial persons. It also includes the current administration of the courts in connection with the absence of the Supreme Judicial Council. At the same time, it also contains the concept of independence and points to individual guarantees to ensure the independent decision of the courts and judges. These include, in particular, the appointment of a judge, requests for judges, and more. The thesis also deals with the organization of judicial power and the concept of independence in Germany. This is then compared with the organization of the judiciary and the concept of independence in the Czech Republic. At the same time, the thesis contains a proposal of possible starting points of the current problems concerning the independent decision-making in the future.en
