dc.description.abstractDiplomová práce se zabývá členěním pohledávek a jejich uplatňováním v insolvenčním řízení. Nejprve je identifikována pohledávka v insolvenčním řízení, představeny možnosti členění pohledávek a jejich charakteristika. Dále práce analyzuje typy a charakteristické vlastnosti insolvenčních pohledávek. Práce se zabývá i dvěma nejčastějšími typy incidenčních sporů, ke kterým může dojít při procesu uplatňování pohledávek. V textu práce jsou řešeny hypotézy s návrhy de lege ferenda. Na závěr práce je zpracována problematika pohledávek a jejich uplatňování ve Spolkové republice Německo a ve Spojených státech amerických.cs
dc.description.abstract-translatedThis thesis deals with a classification of claims and their assertion in insolvency proceeding. At first comes a definition of an insolvency claims, intruduction of their classification and their characteristics. The thesis also analyzes the types of claims and their specific feutures. Furthermore are introduced two major types of adversary disputes which could arise during insolvecy proceeding. The thesis examins established hypothesis and provides suggestions de lege ferenda. Last part of the thesis concerns with legislation, classification of insolvency claims and their assertion in Germany and in the US.en
