| dc.description.abstract | Tato rigorózní práce se zabývá blasfemií, respektive ochranou náboženského sentimentu věřících. Autor předkládá práci, která téma blasfemie a ochrany náboženského sentimentu pojímá ze široka. Na úvod práce se autor věnuje právu na svobodu projevu, respektive právu, na základě, kterého lze blasfemické výroky šířit. Následně se autor věnuje právům, do kterých může být blasfemickým výrokem zasaženo, tedy právu na svobodu náboženského vyznání, resp. právu na ochranu náboženského sentimentu věřících a právu na soukromí. Následující kapitola je věnována vzájemnému střetu těchto práv a metodice jeho řešení v judikatuře Evropského soudu pro lidská práva ve Štrasburku. V závěrečné kapitole se autor věnuje blasfemii, respektive následkům zásahu do náboženského sentimentu věřících v podústavním právu. Prostor je věnován především právní úpravě náhrady nemajetkové újmy v občanském zákoníku, a to s ohledem na možnost odškodňovat zásah do náboženského sentimentu věřících jako nemajetkovou újmu. Následně autor analyzuje právní úpravu v dalších relevantních podústavních předpisech (např. trestní zákoník, antidiskriminační zákon apod.). Autor tak vytvořil ojedinělou práci, která pojímá blasfemii, resp. ochranu náboženského sentimentu věřících ze všech myslitelných právních pohledů. | cs |
| dc.description.abstract-translated | This rigorous paper deals with blasphemy, respectively with the protection of religious sentiment of believers. The author presents a thesis that broadly encompasses the topic of blasphemy and the protection of religious sentiment. At the beginning of the thesis, the author deals with the right to freedom of speech - ie the right on the basis of which blasphemous statements can be disseminated. Subsequently, the author deals with the laws that may be impacted by blasphemous statements; ie the right to freedom of religion and the right to the protection of religious sentiment of believers and the right to privacy. The following chapter concerns the conflict of these rights and the methodology of its resolution in the case law of the European Court of Human Rights in Strasbourg. In the final chapter the author deals with blasphemy, specifically the consequences of interference in the religious sentiment of believers in constitutional law. Emphasis is placed mainly on the legal regulation of compensation for non-pecuniary damage in the Civil Code, with regard to the possibility of compensating for interference with the religious sentiment of believers as non-pecuniary damage. Subsequently, the author analyzes the legal regulation in other relevant sub-constitutional regulations (the Criminal Code, Anti-Discrimination Act, etc.) In conclusion, the author created a unique thesis, which examines blasphemy and the protection of the religious sentiment of believers from all conceivable legal perspectives. | en |
