dc.description.abstractPředložená práce se pokouší z širšího odstupu zhodnotit probíhající proces europeizace soukromého práva a artikulovat jeho vývojové trendy. Práce se snaží kriticky zanalyzovat, zda viditelný rozpor mezi činorodou aktivitou na poli unijní legislativy, judikatury, ale i spontánních výstupů soft law, a nikoli zcela přesvědčivým fungováním v právní praxi, není způsoben některými systémovými nedostatky, které dalšímu vývoji sjednocování soukromého práva zabraňují. Zabývá se rovněž vztahem spontánní a cílevědomé europeizace v tom smyslu, jaký skutečný vliv v praxi výstupy spontánní europeizace mají na souběžnou oficiální europeizaci závaznými unijními právními akty. Hlavním cílem je zachytit fenomén europeizace soukromého práva, pokud možno komplexně a současně v dynamickém pohledu, který nejlépe odpovídá charakteru tohoto procesu.cs
dc.description.abstract-translatedThe presented thesis attempts to evaluate the ongoing process of Europeanization of private law and to articulate its development trends from a broader perspective. The thesis seeks to critically analyze whether the visible discrepancy between fruitful activity in the field of EU legislation, case law, and soft law spontaneous projects on one hand, and not entirely convincing legal practice on the other hand, is caused by systemic shortcomings that prevent further development of unification of private law. It also deals with the relationship between spontaneous and official Europeanization in the sense of what real effect in practice the outputs of spontaneous Europeanization have on the parallel official Europeanization by binding EU legal acts. The main goal is to capture the phenomenon of Europeanization of private law, as comprehensively as possible and at the same time in the dynamic perspective, which best corresponds to the nature of this process.en
