dc.description.abstractDiplomová práce se zabývá problematikou řešení sporů v rámci Světové obchodní organizace (WTO). Cílem práce je analyzovat vývoj a fungování systému řešení obchodních sporů, porovnat jeho podobu v období GATT a po vzniku WTO a posoudit, zda mechanismus podle Dohody o pravidlech a řízení při řešení sporů (DSU) přispěl k efektivnějšímu řešení sporů. Práce nejprve představuje historický vývoj, vedoucí ke vzniku WTO, a dále se zaměřuje na její strukturu, cíle a základní zásady. Podrobně rozebírá systém řešení sporů, jeho jednotlivé fáze, včetně role Odvolacího orgánu, a věnuje se i současné krizi tohoto orgánu a jejím možným řešením. V závěrečné části práce jsou analyzovány konkrétní případy sporů mezi Evropskou unií a Spojenými státy americkými. Při zpracování byla využita komparativní a analytická metoda, a čerpáno bylo z odborné literatury i relevantních mezinárodních dokumentů.cs
dc.description.abstract-translatedThis thesis focuses on the dispute settlement within the World Trade Organization (WTO). The main objective is to analyze the development and functioning of the WTO's dispute settlement mechanism, compare its operation under the General Agreement on Tariffs and Trade (GATT) with the system established after the founding of the WTO, and assess whether the Dispute Settlement Understanding (DSU) has contributed to more effective dispute resolution. The thesis begins with a historical overview leading to the establishment of the WTO, followed by a discussion of its structure, objectives, and core principles. It provides a detailed examination of the dispute settlement process, including the role of the Appellate Body, and addresses the current crisis affecting this body and potential solutions. The final part analyzes selected WTO disputes between the European Union and the United States. The thesis uses comparative and analytical methods and draws on scholarly literature as well as relevant international documentsen
