dc.description.abstractTato diplomová práce je zaměřena na svobodu projevu a svobodu tisku v soudní judikatuře. Práce je rozdělena do pěti hlavních kapitol. V první se pojednává o pojmu svobody projevu jako takovém a vývojem svobody projevu v České republice a ve světě. Druhá kapitola obsahuje pozitivně právní úpravy svobody projevu na mezinárodní i vnitrostátní úrovni, se zaměřením na konkrétní ustanovení upravující meze svobody projevu. V třetí kapitole se pracuje s předpisy, které souvisejí se svobodu tisku v rámci České republiky a jsou zde zmíněny možné střety svobody tisku s jinými právem chráněnými zájmy. Ve čtvrté kapitole se popisují a analyzují vybraná soudní rozhodnutí soudů České republiky. Pátá, a tedy poslední kapitola obsahuje popis a analýzu rozhodnutí Evropského soudu pro lidská práva s přihlédnutím k jejich precedentní významnosti.cs
dc.description.abstract-translatedThis diploma thesis is focused on freedom of speech and freedom of the press in judicial jurisprudence. The thesis is divided into five main chapters. The first deals with the very concept of freedom of expression and the development of freedom of expression in the Czech Republic and in the world. The second chapter contains positive regulations of freedom of expression at international and national level, focusing on specific provisions governing the limits of freedom of expression. The third chapter deals with regulations related to freedom of the press in the Czech Republic and mentions possible conflicts of freedom of the press with other rights protected by the law. The fourth chapter describes and analyzes selected jurisprudences of the courts of the Czech Republic. The fifth and therefore the last chapter contains a description and analysis of the jurisprudences of the European Court of Human Rights, taking into account their precedential significance.en
